The Demise of the 28-Clause Peace Proposal for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe experienced widespread relief on Monday, as the diplomatic emergency caused by the introduction of a new 28-article proposal for ending the war appeared – temporarily – to have been stabilised. A Washington representative spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its response: another massive barrage of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of conflicting incidents captured the harsh reality of the outgoing year. By day, negotiation efforts are waged: optimistic declarations are delivered from multiple capitals. Significant resources is devoted on managing particular approaches. By night, Russian leadership clearly shows the world that, for them, conflict continues to be the primary tool for achieving "resolution".

Nocturnal Warfare

As military strikes developed into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was revealed. Ukraine is equipped to monitor rocket firings from Russian territory, a capability afforded by current data. From witness perspectives, defense planes that had been scrambled to counter approaching guided weapons roared overhead – sophisticated military planes provided to Ukraine by Western partners.

Soon thereafter, Kyiv's missile defense activated: defensive missiles fired to intercept a Russian ballistic missile. This was a advanced protection mechanism at work, presumably provided by allied countries. Every launch jolts you unexpectedly, causing tremors. The moment of terror quickly gives way to grim resignation: maybe the hostile projectile won't strike its target this time, protecting urban areas from catastrophe and further power outages.

Persistent Threats

Following this, a large-caliber weapon engaged a unmanned aircraft in the vicinity, part of a mobile-fire group – probably imported technology. Unfortunately, the bullets missed the hostile drone – it continued its flight toward its objective.

With pauses, this persisted until dawn. Kyiv awoke to the morning news: seven people killed, damage and utility failures in many homes as a result of the evening attack. As typically, everyone still maintained normal activities – enduring hostilities. But those full day encapsulated Ukraine's critical military reliance on Western support – a dependence that neighboring countries are evidently unprepared to replace in the immediate future.

Unsuccessful Negotiations

The 28-point plan from American leadership provoked deep reactions, controversy and serious worry – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and multilateral gatherings.

Every new proposal from Washington unfolds according to the consistent cycle: a political offensive against Ukraine, which Kyiv, with partner nations, manages to fend off. They contain the crisis but never actually win the battle. This pattern will, certainly, persist.

Tactical Assessments

It is tempting to accuse particular leaders of persistently promoting Russian terms. But that does not seem to be the whole story. Washington operates on a principle familiar among experienced diplomats: you cannot achieve through diplomacy what you have been unable to protect through force. The American government believes that it is unfeasible to force Russia to surrender the land that it currently occupies in Ukraine's occupied territories.

The challenge is that while acknowledging this situation, American administration does nothing to deter Moscow, through statements or actions, from believing that the current condition will not change more in its benefit in the coming year.

Opposing Positions

Therefore, Russian leadership is certain that duration works to their advantage – that Ukraine and its supporters are approaching exhaustion. Their incentive to accept conditions that does not give them the maximum possible gain is virtually nonexistent. There may be many attempts to end hostilities, but they will persist as long as Russia's government remains supremely confident in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, progressively conceding lives and land but preventing a complete military breakdown until situations evolve in its favour.

Present Conditions

Realistically, there are no real preconditions for a armistice. Now, subjective factors are becoming relevant: political desires to mediate resolution and secure international recognition, and the government's dual difficulties – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the flag against any proposal Kyiv finds unacceptable, so that their focus does not shift toward domestic problems. And although their mission will now be considerably more difficult after recent developments, it remains highly unlikely that this will modify their basic position.

These opposing factors are guiding negotiations.

Assessment and Future

It took a just a single week to kill the 28 points of the most recent proposal. Aggressive and erratic handling of the matter by Washington, opposition by Ukraine and the other European countries, along with soothing efforts of diplomats, and finally, latest revelations, all did their job.

While new plans based on established approaches are forthcoming, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to counter political attacks from Washington that are founded on Moscow's terms and show specific hesitation to modify developments, if they maintain solidarity and enhance their military capacity at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the predictable period, mainly require ongoing international assistance.
